DMCA, Copyright & Content Complaints Policy

Adwave Inc. (“Adwave,” “Wavemaker,” “we,” “us,” or “our”) respects the intellectual-property and personal rights of others and expects users of the Wavemaker platform (“Service”) to do the same. We comply with the Digital Millennium Copyright Act (“DMCA”) and respond to valid notices of alleged copyright infringement, as well as to good-faith complaints about trademark and right-of-publicity (name, image, likeness, and voice) concerns.
How Wavemaker Works
Wavemaker is an AI video generation platform that orchestrates third-party AI services (including image, video, voice, music, and language models) to produce content on behalf of users. Adwave does not develop, train, or operate its own foundation AI models. All AI-generated content is produced by third-party services based on user-provided prompts and inputs. Users are solely responsible for the content they create and for clearing the rights needed to use it (see our Terms of Service, Sections 6–11).
Scope
This Policy applies to content hosted on or made accessible through the Service (for example, in a public gallery, on a shared link, or in an embed). Once a user exports or downloads content, we no longer control how it is used or distributed. Complaints about how exported content is used should be directed to the user or platform distributing it.
1. Copyright Infringement (DMCA Notice)
If you believe content available through the Service infringes a copyright you own or control, send a written notice to our designated agent (below) that includes:
- Identification of the copyrighted work you claim has been infringed (or a representative list if multiple works).
- Identification of the allegedly infringing material and information reasonably sufficient to locate it (such as the gallery URL, shared link, session ID, or video title).
- Your contact information — full legal name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on its behalf.
- Your physical or electronic signature.
Caution: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing (or was removed by mistake) may be liable for damages, including costs and attorneys’ fees.
2. Trademark Complaints
If you believe content available through the Service infringes your trademark or creates a likelihood of confusion, send a written complaint to [email protected] that identifies: your mark and registration (if any); the allegedly infringing content and its location; the basis for your complaint; and your contact information, with a statement of good-faith belief and your signature.
3. Right of Publicity / Likeness / Voice Complaints
If you believe content available through the Service uses your (or a person you represent’s) name, image, likeness, or voice without authorization, contact [email protected] with: identification of the person and the content; its location; an explanation of the unauthorized use; and your contact information and relationship to the person, with a statement of good-faith belief and your signature. For non-consensual intimate imagery or content sexualizing a minor, mark your message URGENT; such content is strictly prohibited and we act on it as a priority.

5. What Happens After a Notice
Upon receiving a valid notice, we will:
- Promptly remove or disable access to the identified material;
- Notify the user who posted it (if identifiable) that it has been removed; and
- Provide that user information about submitting a counter-notification (for copyright matters).
We may, at our discretion, also restrict or suspend the responsible account consistent with our Terms of Service.
6. Counter-Notification (Copyright)
If you believe your content was removed by mistake or misidentification, you may submit a counter-notification to our designated agent that includes:
- Identification of the removed material and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your judicial district (or, if outside the U.S., any judicial district in which Adwave may be found), and that you will accept service of process from the party who submitted the original notice.
- Your physical or electronic signature.
Upon receiving a valid counter-notification, we will forward it to the original complainant and may restore the material in 10–14 business days unless the complainant files a court action seeking to restrain the activity.
7. Repeat Infringer Policy
We will terminate, in appropriate circumstances and at our discretion, the accounts of users we determine to be repeat infringers, considering the totality of the circumstances.
8. AI-Generated Content and Third-Party Models
The AI models used by the Service are developed and operated by third parties; Adwave does not control their training data, weights, or specific outputs.
- For content currently hosted on or accessible through Wavemaker, submit a notice as described above and we will act on valid notices.
- For concerns about the underlying AI models themselves (for example, their training data or generative patterns), we recommend contacting the relevant AI model provider directly, as they control those models.
Users are solely responsible for reviewing and clearing AI-generated content for potential intellectual-property and personal-rights issues before publishing or distributing it.
